Wills: Basics & Legal Requirements
What is a will? A legal document that outlines how your assets should be distributed after your death.
Who can make a will in WA? Anyone who is over 18 years old and of sound mind
What constitutes a valid will? A document in writing recording your testamentary intentions, signed by you, and witnessed by two independent adults. Even where a will may not comply with all of these requirements, it may still be acknowledged as a valid Will.
Can I write my own will? Yes, but it’s best to get legal advice to avoid errors or disputes. Most estate disputes concern poorly drafted or DIY wills.
Updating & Changing Your Will
How do I update my will? You can create a new will or add a codicil (a legal amendment to your existing Will).
When should I update my will? After major life changes—marriage, divorce, birth of children, or acquiring significant assets, establishing new business or investment structures, death of family members etc.
Executors & Probate
What is an executor? The person responsible for carrying out your wishes and managing your estate. This person must do what the Will says in a timely and efficient manner.
What is probate? A legal process to validate the will and allow the executor to distribute assets. This typically involves making an application for a Grant of Probate
How long does probate take to issue from the Court in WA? Typically, 4–6 weeks, depending on complexity.
Dying Without a Will
What happens if I die intestate (without a will)? Your estate is distributed according to WA’s intestacy laws, which may not reflect your wishes.
Can someone contest my will? Yes, eligible people (e.g. spouse, children) can make a family provision claim if they feel inadequately provided for. In some cases former spouses and step children can also make claims, it is therefore important to ensure you obtain expert advice in this regard.
How long does estate administration take?
